Terms and Conditions

(b) Subscribe to a fixed-term or renewable subscription ("Subscription"). The Service (including Content, features, and functionalities) may vary depending on:

(a) your device and your place of residence

(b) whether you access the Service as an unregistered guest, GPT MESSENGER Account holder, or subscriber;

(c) the type of Subscription you have chosen;

(d) any restrictions imposed by our business partners, including regarding the rights granted to us; and

(e) whether you have subscribed to a Subscription directly from us, through another service, or from one of our third-party partners (please see Article 11 for more information).

When creating your Account or subscribing to a Subscription, you must provide us with truthful, accurate, and complete information. You may be able to use an existing account with a third-party platform or another partner to create an Account, for example, your login data with a social media service. You are responsible for the login credentials of your Account, their confidentiality, and all activities carried out under their cover (including any access and use of the Service through your Account). We recommend not disclosing your payment information and login credentials to anyone else.

You agree to keep your Account login credentials (including contact and payment information) up to date, accurate, and correct at all times during the use of the Service. We are not responsible for any losses or issues resulting from inaccurate or incorrect Account information you have provided to us.

The Customer has a monthly subscription to access the information offered by GPT MESSENGER.

Prices are in USD ($). The subscription is without a fixed term.

The details of the Subscription are made known to the Customer in these Terms and Conditions: the subscription price is $49.90 per month with a 7-day trial offer for $1.00

If the customer benefits from a free period, it will be automatically renewed to a subscription at the end of it.

If you subscribe to a Subscription from us, information regarding the price, currency, and whether the Subscription will automatically renew or not will be provided to you before you finalize your subscription. Once your registration is completed, you can access information about your Subscription at any time by visiting your Account.

Some Subscriptions are automatically renewed unless you cancel your Subscription before the next renewal date (or before the end of any free access period). If you purchase a Subscription through us, we will inform you, at the time of registration, if your type of Subscription will be automatically renewed.

For more information on how to disable automatic renewal, please refer to our Help Center. If you have purchased a Subscription directly through us, you can also disable automatic renewal by sending an email to contact@gpt-messenger.io

The decision not to renew the Subscription will not result in the payment of damages or any compensation, subject to the settlement of invoices issued by GPT MESSENGER.

When you cancel a Subscription, you are only canceling future fees associated with your Subscription. You can cancel your Subscription at any time, but the cancellation will take effect at the end of the current billing period.

To avoid future fees, you must cancel your Subscription at least 3 days before the end of your current subscription period. If you cancel before the deadline, no additional charges will be incurred. Your cancellation will take effect at the end of your current subscription period, and you will continue to have access to your Subscription for the remainder of the subscription period.

To cancel your Subscription, please send us an email request to the following address: contact@gpt-messenger.io, at least 3 days before the end of your current subscription period.

If you cancel your monthly Subscription, you will only be charged for the number of months of your Subscription, and your access to our digital services will end upon cancellation. If you subscribe to multiple products or services, canceling one product or service may not result in the cancellation of all products or services.

If you have subscribed to an automatically renewing Subscription or a Subscription with an initial free access period through us, you can cancel it at any time before the end of each Subscription period (or free access period). Upon termination, you can continue to use your Subscription until the end of the current Subscription period (or free access period), and you will not be eligible for a refund for the current Subscription period.

You will be informed, at the time of subscribing to a Subscription, of any applicable minimum duration, including the fact that it always corresponds to your billing period.

If you have subscribed to a Subscription through a third party configured for automatic renewal and wish to cancel your Subscription, you must do so through that third party. For example, you may need to access your device settings or visit your app store account and disable automatic renewal for GPT MESSENGER.

UNLESS OTHERWISE STATED IN THESE TERMS OF SALE OR REQUIRED BY APPLICABLE LAW, ALL FEES FOR OUR SERVICES ARE NON-REFUNDABLE. This includes fees for Subscriptions and in-app purchases, even if you request cancellation of your Subscription or Account. You may not be entitled to a refund for any Subscription fees you have paid.

If you believe you are entitled to a refund under applicable law, please contact us. If you purchase a Subscription through a third party and are entitled to a refund under applicable law, you must contact the third party for a refund.

Please note that for certain Subscriptions, we may process your refund through the third party that processed your payment for the Subscription.

As part of the Service, we provide you with access to a wide variety of information, including text, graphics, videos, music, software, and other materials (collectively referred to as "Content"). Some of this Content may be provided by us, while other Content may be provided by third parties. All Content provided by us is owned by or licensed to GPT MESSENGER, and is subject to copyright, trademark, and other intellectual property rights under applicable law.

You are only authorized to use the Content for personal and non-commercial purposes. You may not use the Content for any other purpose without the express written consent of GPT MESSENGER or the respective copyright holder. You may not reproduce, modify, distribute, publicly display, publicly perform, or otherwise use the Content in any way that violates the rights of any third party.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GPT MESSENGER, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (F) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL GPT MESSENGER, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO GPT MESSENGER HEREUNDER.

You agree to indemnify and hold harmless GPT MESSENGER and its affiliates, agents, officers, directors, employees, suppliers, and licensors from and against any losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) relating to or arising out of any claims, proceedings, or investigations arising out of or relating to (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your use of the Service.

These Terms of Use and any disputes arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of the United States and the UAE, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service, including any disputes regarding the existence, validity, or termination of these Terms, shall be subject to the exclusive jurisdiction of the federal and state courts located in the UAE, and you agree to submit to the personal jurisdiction of such courts.
